Obama asserts executive privilege on Fast and Furious

Washington (CNN) - An extraordinary House committee hearing began considering a contempt measure against Attorney General Eric Holder on Wednesday even though President Barack Obama asserted executive privilege over documents sought by the panel investigating the botched Fast and Furious gun-running sting.

Committee chairman Rep. Darrell Issa, R-California, said the White House assertion of executive privilege "falls short" of any reason to delay the hearing.

However, the committee's top Democrat, Rep. Elijah Cummings of Maryland, accused Issa of setting an "impossible standard" for Holder by demanding documents the attorney general was legally prohibited from providing.

Issa has "no interest in resolving" the dispute with Holder, Cummings said.

Wednesday's development further heightened the drama of a high-profile showdown between Issa and Holder over the committee's demand for the Department of Justice to turn over more documents about the Fast and Furious program.

The White House move means the Department of Justice can withhold the documents from the House Oversight Committee, which was scheduled to consider a contempt measure Wednesday against Holder.

This is why Nixon once said "it';s not a crime when the president does it", because the POTUS is in practice somewhere between a president and a king. Governors are the same way. Ever wonder why these are the only people in our country who can pardon a crminal, even one on death row, with no obligation to explain anything? Why give a power that clearly implies one is above the law? This can and does breed a dangerous arrogance. The founding fathers screwed this one up.

      Yes Jean it is likely–or not really. If that was the case, why in the world would he be withholding records, especially this late in the game? He had Holder reviewing this for months to determine if it was going to expose him, and NOW that he knows it will, he is pulling this card?

      On a separate note, I believe the administration is using this as a distraction from the real issues (as you have pointed out) to turn focus from his other records as pres. It'll drag out for a couple weeks (month), the administration will lead the Holder Lamb to slaughter as a scapegoat, provide a relatively plausible explination for the fiasco that will pacify the generally uninformed and they have bought 30 days of misdirected focus. Don't know if it happened from convenience or by design, but you can "never let a good crisis go to waste."

      And yes...Operation Gunwalker and Fast & Furious were the same operation just different administrations.
      Seems the GOP wants everyone to develop amnesia...so they can have a do-over.

        First–wide receiver and F&F were not the same–they were similar (and F&F may be the b@st@rdized son of wide reciever) but the differences are comperable to hitting a jaywalker at night vs.hitting someone while you are drinking and driving–look up the specifics in the difference between the programs.

        Second–if we accept your premise that they are the same program: you all HATED every Bush policy, but now defend one that this administration's botching of it? A few hundred guns under Bush, with a handful "lost" vs. over 2000 with F&F with more than 1400 unaccounted for...If this was such a great program, then give Bush credit for it, if it was such a terrible program, then why did this administration not only maintain it, but expand it?

        Last–If you are going to blame Bush for a failed program that Obama–3 years later–had continued, then where is the admiration for Bush's program of searching for bin Laden that just happened to conclude under Obama? The specifc Pakistani intelligence gathering for OBL had been started during Bush's term. So "Thank you President Bush for enacting the intelligence gathering that eventually brought an end to OBL." Or is that too tough of a pill to swallow?

This is a classic ploy of liberals, in that they believe that "he who is loudest, is rightest". As far as Dubya, the president cannot send our troops into battle without the approval of congress. A lot of Democrats, including I believe Pelosi, voted to send our troops over there. The difference is, when war gets tough, as it inevitably does, the spineless democrats start abandoning ship, and conveniently forgetting their own contributions. Dubya is gone, and has been for 31/2 years. Did your boy pull us out as he promised? NO. He ordered the surge, a move that I actually agreed with, even he was going back on his promise. Did he close Guantanamo? NO. He realized that it was a needed commodity, as disgusting as it may seem. Did he come through on that promise of transparency? NO. He has created more czars than any previous president. He has repeatedly refused to cooperate with congressional investigators. He has authorized the military to use drones to spy on YOU. What if Bush had done that? There would have been open revolt, but because he is Obama, you seem to be just fine with that. He has done nothing for three years except blame Bush for his own shortcomings. But as long as he keeps pandering to your particular special interests with you. Tell me, what is he buying your loyalty with? Welfare. Gay rights?

I guess crime does pay. Steal cars and end up in Congress. If Holder is guilty then he just needs to follow Issa's lead. Do wrong and you get elected to Congress and then head up investigative committiee's.

        At times I have noted when Obama has done presidential things like visit vets. I won't be fooled again. Everything Obama does is political and for Obama. He could not care less about the country he is supposed to be leading. He even threw his wife under the bus to get a laugh.
        His recent action here tells me he was involved. He would not do this just to protect Holder – given that he throws everyone under the bus to try make himself look good. He is without a doubt the worst president this country has even seen.

      Stop listening to the lies – or at least catch up. Obama and Holder said Bush started F+F initially, but they have since admitted they "mis-spoke and were mistaken" and they own it.
      It shouldn't surprise you that they blame Bush – it is what Obama does best...

      What? This order was most likely to protect Holder (at least) and maybe Obama. We do not know because this administration first said they didn't know anything, then they send a memo saying they were not involved, then they retracted that memo, then they said there was nothing to see, now we get this "executive order" and they still have not released pertinent documents. Anyone could provide thousands of pages of stuff that is not pertinent and hold back documents that will show who knew what, when then say "I gave you thousands of documents". There are an estimated 140,000 pages that did not get turned over.
      Given the trail of the coverup, anyone would think they are hiding something.

    its really funny how some of these left wing nut cases are trying to blame this one on President Bush. When all you need to do is read a little to understand obama and obama appointees let this thing go off the cliff and are now are desperately trying to hide their ineptness....good luck obama, your ineptness is impossible to hide domestically/legally and in foreign policy. We have a lame duck presidency now and we would have the same if obama by some real stroke of luck were releected...so the obvious solution is clean house and elect a real adult with a real resume'.

    What Obama has learned is that it is real easy to sit on the outside, fat, happy, and ignorant, (emphasis on the ignorant) and make accusations and promises, but it is a whole world different when you are the one on the hot-seat. He got elected by an electorate of liberal dreamers, and was wholly un-prepared for the job, and his performance has shown it. He wanted the position solely for the right to be the "first black president", and to feed his tremendous ego, and the media, and a lot of young voters, and older confused voters got caught up in the fervor to be "the generation that elected the first black president" made it happen. Now, he feels like he is untouchable, and should this country be stupid enough to re-elect him, his ego and boldness will know no bounds. I predict that within 60 days of his being re-elected (God forbid) the stock market will crash, as the money people of this country throw up their hands in disgust and pull out en masse.

      DEcember 2012, I agree that congress has no business wasting time on that issue, or Roger Clemens, or any other sports related issue, but there is no comparison between them, and the investigation(s) into the abuses of power being carried out by Obuma. Yes, It is a very serious issue when the president covers up his and his cronies in an investigation involving multiple murders, or bypasses the legislative process to impose his own brand of law, or leaks National Security secrets just to inflate his own image. As far as corrupt congressman and congresswomen, neither party has a patent on that. The best policy is to vote all of the old guard out, and keep a high turnover rate so that they do not have time to build fiefdoms.

I hope we have come to the end of the line with the current politics of division in this country...obama brought the awareness of these politics to new prominence. We need to demand more of our representation and yes, it is time to get rid of the career politicians. We need REAL American citizens, with American brains representing real Americans.

    "actually Operation Wide Receiver was shut down right after guns were lost track of in 2007. It was investigated, documents were publicly released and that was the end of gun walking programs. It was an acknowledged failure and was stopped by the admin due to losing guns. Mexican authorities were also involved and aware of the program and the guns."

    The two programs are similar, but completely separate. This one is all on Obama & Co.
